Scrutiny shows procedural mistakes by polling officials, minor arithmetic errors

A report on the Supreme Court-ordered inspection, scrutiny, and recount of votes at 45 polling stations has revealed minor arithmetic discrepancies in votes tallied for stations where forms were intact but do reveal a mix-up in the use of the two sets of form 34As, with some of them unaccounted for.

According to the report, filed by the Supreme Court Registrar and obtained by NTV, six voting stations did not have any form 34A Book 2s, 26 had complete form 34A Book 2s, and nine had used form 34A Book 2s with varied numbers of carbonated copies.

According to the report, several returning officers justified the lack of form 34 A Book 2 by claiming that the presiding officers utilized them instead of form 34 A Book 2.

“In such cases, the team verified the information by looking for the form 34 A Book 1 to confirm if it was indeed intact for purposes of accountability.” reads the report in part.

According to the report, the returning officers allege that several presiding officers mixed up the two books because they didn’t grasp the procedures.

In July, following a meeting with representatives of Presidential candidates, Chebukati acknowledged the concerns about the printing of two sets of Form 34A. Chebukati later emphasized that just one form 34A was to be utilized, with the second booklet left blank and locked in the ballot box after voting.

According to the scrutiny report, other returning officers had no explanation for the lack of form 34 A book 2 and stated that they had only learned about the irregularity along with the scrutiny.

“The Kiambaa constituency returning officer explained that her presiding officer used book 2 because he had spoilt book 1. They, however, did not present the spoilt form 34A book 1 for the team’s scrutiny, and the PSD did not indicate that the form 34A book 2 had been spoilt.” the report reads.

There was a computation error in Form 34A at Kapsuser Primary School polling station 2 of 3, but the votes cases for each candidate were accurately recorded. Raila received seven votes to Ruto’s 431 in the polling station, but the presiding officer reported 429 total votes cast. However, a recount revealed that there were 438 total votes cast at the station.

According to the report, certified Form 34A was not inside the ballot box at Majengo Primary School polling station 2 of 2. The report however states that all of the seals were intact and that there were no variations between the numbers on them and those on the Polling Station Diary.

According to the report findings, some returning officers had Form 34A Book 2 inside the ballot boxes while others presented the forms and the ballot boxes separately.

The report further indicates that all of the returning officers who appeared before the scrutiny team stated that they did not use the manual register and hence did not have Form 32A to present.
