Court to receive report on 41 polling stations, as Azimio decries limited server access
The Supreme Court will today receive the report from the scrutiny of 41 polling stations ordered earlier this week. The highly anticipated report will either support the petitioner’s claims of systemic failures or tear their theory apart.
Recounting of the ballots was concluded last night, as the parties meet from 10am Thursday to review their report before filling it at the Supreme Court’s registry.
The exercise that was overseen by the Deputy Supreme Court registrar revealed discrepancies in Form 34A with one polling station in Majengo Primary School in Mvita, Mombasa missing Form 34A in the ballot box. In one of the polling stations at the school, President-elect William Ruto garnered 96 votes while Azimio-One Kenya presidential candidate Raila got 76.
So far, no discrepancies have been unearthed between the forms uploaded on the IEBC portal and the ballots recounted.
While addressing the court this morning, Philip Murgor, who is among the lawyers representing Raila Odinga and Martha Karua, claimed that the IEBC is not cooperating with the orders given to provide access to electoral servers.
“IEBC continues to refuse to provide the forensic image of all eight servers,” Murgor said.
Of the eight servers, the first petitioner says IEBC has only provided limited access to server No. 5, from which they have observed a large number of deletions.
“We suspect and are concerned that the delay on the part of IEBC is to delete vital data and when finally time runs, not to provide the information we require or provide logs that have no use to anybody,” Murgor said.
Azimio are now seeking forensic access to all eight servers and copies of logs to all of the servers. Murgor said the directive is to be given right away.
Three petitioners sort to be allowed to scrutinise ballot papers from a different number of polling stations.
Otieno Ogolla wanted to be allowed scrutinise 229 polling stations, Njoki Mboche 238 stations and the first petitioner (Raila Odinga and Martha Karua) asked for 517 stations which were impossible.
“There are only 48 hours to scrutinise the 15 polling stations that were indicated by the court. We thought that the order is specific to contested polling stations,” Justice Isaac Lenaola.
